Users shall not engage in any activity that infringes upon or violates the intellectual property rights of APELABS or any third party. Prohibited activities include, but are not limited to, reproducing, distributing, modifying, creating derivative works of, publicly displaying, or commercially exploiting any intellectual property belonging to APELABS or third parties without explicit permission. Users must not circumvent, disable, or interfere with security-related features or technological measures employed by APELABS to protect its intellectual property rights.
APELABS respects the intellectual property rights of others and expects Users to do the same. If you believe that any content on the Site infringes upon your intellectual property rights, please promptly notify APE LABS in writing, providing the following information: A detailed description of the intellectual property rights being infringed; Identification of the infringing material and its location on the Site; Sufficient information for APELABS to contact you, including your name, address, telephone number, and email address; A statement declaring that you have a good faith belief that the use of the material is not authorized by the intellectual property rights owner, its agent, or the law; A statement made under penalty of perjury that the information provided in the notice is accurate and that you are the intellectual property rights owner or authorized to act on their behalf. APELABS will investigate the reported intellectual property infringement and take appropriate action, which may include removing or disabling access to the allegedly infringing content. APELABS may also terminate the accounts of Users who repeatedly infringe intellectual property rights.
Users are solely responsible for ensuring that any content they post or submit to the Site does not infringe upon the intellectual property rights of others. Users shall not use the Site to reproduce, distribute, or publish any copyrighted material, trademarks, trade secrets, or other proprietary information without obtaining the necessary permissions or licenses. If Users believe that their own intellectual property rights have been infringed upon by another User‘s content, they may follow the reporting process outlined in section 5.
The Site may contain links or references to third-party websites, products, or services. APELABS does not endorse or assume any responsibility for the intellectual property practices or content of these third parties. Users are encouraged to review the intellectual property policies of these third parties when accessing their websites or using their services.
If you believe that content that you posted on the Site has been wrongfully removed due to a copyright infringement claim, you may provide APELABS with a counter-notice.
Your physical or electronic signature;
Identification of the content that was removed or disabled and the location on the Site where it appeared before removal or disabling;
A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification;
Your name, address, telephone number, and email address; - A statement that you consent to the jurisdiction of the appropriate courts located within your jurisdiction and a statement that you will accept service of process from the person who provided the original copyright infringement notification or an agent of such person.
Upon receipt of a valid counter-notice, APELABS may reinstate the removed content, unless the copyright owner files a lawsuit seeking a court order to restrain the user from engaging in infringing activity related to the removed content.
APELABS reserves the right to modify or update this Intellectual Property Policy at any time, without prior notice, to reflect changes in laws, regulations, or industry best practices. The updated Policy will be effective upon posting on the Site. It is your responsibility to review this Policy periodically to ensure your continued compliance. By accessing or using the Site after any modifications to this Policy, you agree to be bound by the revised terms.
